Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any application ("App") developed by Osavus Technology Ltd ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Apps.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes, subject to these Terms of Service.

3. User Accounts

Some features of our Apps require you to create an account using Google or Apple sign-in. By creating an account, you agree to:

• Provide accurate information during the authentication process
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Services and Features

Our Apps may include the following features:

• Local Gameplay: Play games stored locally on your device
• Cloud Synchronisation: Sync your game progress across devices when signed in
• Central Game Database: Access content from our central game database
• Game Sharing: Share games with others via unique hash codes
• Challenges: Participate in multiplayer challenges with friends or official weekly/monthly challenges organised by Osavus
• Statistics: Track your game statistics, which may be shared with other participants in challenges you join

5. User Conduct

When using our Apps, you agree not to:

• Use the Apps for any unlawful purpose
• Attempt to cheat, manipulate, or exploit challenges or leaderboards
• Use automated systems or bots to interact with the Apps
• Harass, abuse, or harm other users
• Share inappropriate, offensive, or illegal content through game sharing features
• Attempt to gain unauthorised access to our servers or other users' accounts
• Interfere with or disrupt the integrity of the Apps or servers

6. Restrictions

You agree not to:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer your license to use the App to any third party
• Use the App to develop competing products or services

7. Intellectual Property

All content, features, and functionality of our Apps, including but not limited to design, graphics, text, game content, and code, are owned by Osavus Technology Ltd and are protected by copyright, trademark, and other intellectual property laws.

User-generated games shared through our platform remain the intellectual property of their creators, but by sharing them, users grant us a non-exclusive license to store, distribute, and display such content through our services.

8. User Content and Shared Games

When you share games or participate in challenges:

• You grant us permission to store and distribute your shared content
• Your game statistics may be visible to other challenge participants
• Shared games may be accessible to anyone with the hash code
• We may remove content that violates these terms without notice

9. App Store Reviews

We may prompt you to rate and review our Apps on the App Store or Google Play Store. These prompts are optional, and you are not obligated to provide a review. Any reviews you submit are subject to the terms of the respective app store.

10. Disclaimer of Warranties

Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Server services will be continuously available
• Game data synchronisation will always succeed

11. Limitation of Liability

To the fullest extent permitted by law, Osavus Technology Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use our Apps
• Loss of game progress or statistics
• Unauthorised access to your account
• Service interruptions or data loss
• Actions of other users in challenges or shared content

12. Updates and Changes

We may update our Apps from time to time. These updates may include bug fixes, new features, or changes to existing features. Continued use of the App after updates constitutes acceptance of any changes.

13. Termination

We reserve the right to terminate or suspend your access to our Apps and services at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

Upon termination, your right to use the Apps will immediately cease. You may request deletion of your account data by contacting us.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by updating the "Last updated" date. For significant changes, we may also notify you through the app. Your continued use of the App after changes are posted constitutes acceptance of the revised terms.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Estonia.

16. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
